These Terms of Service govern access to and use of roofrigor.com, related storefront features, customer accounts, communications and services offered by RoofRigor Corp. (“RoofRigor,” “we,” “us” or “our”). By visiting the website, creating an account, placing an order or using a RoofRigor product or service, you agree to these Terms and the policies incorporated by reference.
1. Eligibility and acceptable use
You must have legal capacity to enter into a binding agreement and may use the site only for lawful purposes. You must not interfere with the security or operation of the site; attempt unauthorized access; introduce malicious code; scrape or reproduce protected content at scale; misuse another person’s account or payment information; or use the site or products in violation of law or the rights of others.
2. Account and order information
You are responsible for providing accurate, current billing, contact and account information and for protecting your credentials. You are responsible for activity occurring through your account unless caused by RoofRigor’s own breach of duty. Notify us promptly of suspected unauthorized access.
3. Products, pricing and orders
Product descriptions, formats, inclusions, licence tiers, compatibility information and pricing may change before purchase. Prices are shown in the currency displayed at checkout and may exclude applicable taxes unless stated otherwise. An order is subject to payment authorization and acceptance. RoofRigor may refuse or cancel an order for suspected fraud, pricing or listing error, unlawful activity, sanctions or export restrictions, product unavailability or material breach of these Terms. Any payment collected for a cancelled order will be handled in accordance with applicable law and the Refund Policy.
4. Digital delivery and licences
Digital Products are delivered electronically under the Digital Delivery Policy. Purchasing a Digital Product does not transfer ownership of RoofRigor’s intellectual property. It grants only the limited licence described on the product page and in the Terms of Sale and Licence Terms. The Refund Policy, Digital Delivery Policy, Terms of Sale, Professional-Use and Support Disclaimer and Privacy Policy form part of these Terms.
5. Intellectual property
The website, branding, text, graphics, product architecture, templates, forms, guides, spreadsheets, training materials and other content are owned by or licensed to RoofRigor and are protected by intellectual-property laws. Except for rights expressly granted under a purchased licence, no content may be copied, republished, resold, sublicensed, publicly distributed, white-labelled, reverse engineered or used to build a competing product library or service.
6. Professional responsibility
RoofRigor products are workflow and documentation aids. They do not replace the judgment, training, licensing, legal duties or standard of care of the person using them. You remain responsible for site safety, inspection scope, observations, testing, technical references, conclusions, recommendations, regulatory compliance and every report or deliverable issued in your name or organization’s name.
7. Support
Unless a product page expressly includes additional services, support is limited to purchase access, download issues and general file-use questions. Support does not include project-specific roofing, engineering, architectural, code, legal, insurance, claim, accounting or tax advice; review or approval of reports; or professional sign-off.
8. Third-party services
The store may rely on Shopify, payment processors, download-delivery providers and other third-party services. Their services may be subject to separate terms and may occasionally be interrupted or changed. RoofRigor is not responsible for third-party acts or failures beyond the responsibility imposed on us by applicable law.
9. Disclaimers
To the maximum extent permitted by law, the site and Digital Products are provided on an “as available” and “as is” basis. RoofRigor does not guarantee that every product is suitable for every project, jurisdiction, roof system, contract, insurer, authority or professional practice, or that use will produce a particular commercial, technical, legal or claim outcome. Nothing in these Terms excludes a warranty or remedy that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, RoofRigor will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, including lost profit, lost opportunity, loss of data, business interruption or decisions made from user-entered information. Where liability cannot be excluded, RoofRigor’s aggregate liability arising from a particular paid Digital Product will not exceed the amount paid for that product, except where a different limit is required by law.
11. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses and reasonable costs arising from your unlawful use of the site, your material breach of these Terms, your unauthorized distribution of licensed materials or professional deliverables issued by you or your organization. This section does not apply to the extent a claim was caused by RoofRigor’s own unlawful conduct or breach.
12. Changes and termination
RoofRigor may update these Terms prospectively by posting a revised version. The version in effect when an order is placed governs that purchase unless a change is required by law or accepted by both parties. We may suspend access where reasonably necessary to address security, fraud, unlawful activity or a material licence breach.
13. General terms
If a provision is unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions continue. Failure to enforce a provision is not a waiver. These Terms are governed by applicable law, while preserving any mandatory consumer rights and forum rights that cannot be waived.
